Terms & Conditions

These Terms & Conditions form part of the agreement between Hartco Consultancy Ltd and the purchaser of artwork. By making payment, whether in part or in full, the purchaser confirms acceptance of these terms.

1. Contract Basis

This invoice and these Terms & Conditions form part of a contract for the purchase of artwork between the customer and Hartco Consultancy Ltd (Company No. 16059895), registered in England and Wales.

2. Acceptance of Terms

By making payment against an invoice, the customer confirms that they have read, understood and accepted these Terms & Conditions together with any additional policies published on the Hartco Consultancy Ltd website.

3. Customer Relationship

Customers may receive invitations to exhibitions, private sales, promotional opportunities and other communications relating to artwork and collecting.

4. Payment Terms

Payment is due upon receipt of invoice unless otherwise agreed in writing. Accepted payment methods include bank transfer and other approved payment services. Hartco Consultancy Ltd reserves the right to suspend delivery or ownership transfer until cleared funds have been received.

5. Anti-Money Laundering Compliance

Hartco Consultancy Ltd complies with all applicable UK Anti-Money Laundering regulations and may require proof of identity, address and source of funds before completing transactions.

6. Title & Risk

Ownership of artwork transfers only once cleared funds have been received in full. Risk passes to the customer upon collection or delivery.

7. Provenance & Authenticity

Artwork descriptions and provenance information are supplied in good faith based upon information available at the time of sale. No warranty is provided regarding future value or market performance.

8. Sales Representation

Hartco Consultancy Ltd may assist with the presentation of artwork to collectors, galleries and exhibitions. No resale will occur without prior written approval from the owner.

9. Commission & Profit Sharing

Hartco Consultancy Ltd retains a commission of 20% of any net profit realised from artwork resold through the company.

10. Third-Party Services

Where delivery, storage, insurance or other services are arranged through third parties, Hartco Consultancy Ltd acts solely as an intermediary and accepts no liability for those providers.

11. Risk Disclosure

Artwork values may rise or fall. No guarantee is given regarding future value, liquidity or resale success.

12. Right to Cancel

Customers may cancel within fourteen (14) days of payment, subject to any reasonable administrative costs incurred.

13. No Pressure & Financial Suitability

Customers confirm that purchases are made voluntarily and that they have independently considered the suitability of the acquisition for their own circumstances.

14. Limitation of Liability

Hartco Consultancy Ltd shall not be liable for indirect, consequential or economic losses except where liability cannot legally be excluded under English law.

15. Data Protection

Personal information is processed in accordance with UK GDPR and the Hartco Consultancy Ltd Privacy Policy.

16. Entire Agreement

These Terms & Conditions, together with any referenced policies, constitute the entire agreement between the parties.

17. Governing Law

This agreement is governed by the laws of England and Wales and subject to the exclusive jurisdiction of its courts.

18. Artwork Allocation & Substitution

Where reasonably necessary, Hartco Consultancy Ltd may allocate an alternative edition number or substitute an artwork from the same series or collection of equal invoice value where availability changes prior to delivery.

19. Market Value Disclaimer

Any comments regarding artists, market trends or future performance are provided for information only and do not constitute financial, investment or tax advice. Customers acknowledge that artwork values can fluctuate and that purchasing decisions are made independently.
